These Terms of Service ("Terms") govern your access to and use of the website, mobile application, and coaching services operated under the name Fitmate Coach (the "Services"). Please read them carefully.
1. Who We Are
The Services are provided by Pikmate Ltd, a company registered in England and Wales under company number 12536406, with its registered office at Gothic House, Barker Gate, Nottingham, England, NG1 1JU ("Fitmate", "we", "us", or "our").
By creating an account, accessing our website, downloading our app, or otherwise using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Services. Our use of your personal data is described in our Privacy Policy, which forms part of these Terms.
2. Eligibility
You must be at least 18 years old, or the age of legal majority in your jurisdiction, to create an account and use the Services. By using the Services, you confirm that you meet this requirement and that all information you provide to us is accurate and complete.
3. Your Account
To use certain features of the Services, you will need to register for an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us promptly at hello@fitmatecoach.com if you suspect any unauthorised use of your account.
4. Health & Medical Disclaimer
Fitmate provides general nutrition and fitness coaching, tracking, and educational content. It is not a substitute for professional medical advice, diagnosis, or treatment. You should consult a qualified physician or other healthcare provider before starting any new diet, exercise programme, or making changes to existing medical treatment, particularly if you are pregnant, have an existing medical condition, or are taking prescription medication.
Nutritional estimates generated from meal photographs or user input are approximations and may not be fully accurate. You use the Services, and act on any guidance provided through them, at your own risk. We are not liable for any health outcomes arising from your use of the Services.
5. Subscriptions, Fees & Cancellation
Certain parts of the Services are offered on a paid subscription basis. Fees, billing frequency, and cancellation terms will be presented to you at the point of purchase.
- Subscriptions purchased through our website are billed and managed via our payment provider and can be cancelled at any time through your account settings; cancellation takes effect at the end of the current billing period.
- Subscriptions purchased through the Apple App Store are governed by our Subscription Terms (iOS) and are billed, renewed, and cancelled through your Apple ID.
- Except where required by law, fees already paid are non-refundable.
6. Free Trials & Promotions
We may from time to time offer free trials or promotional pricing. We reserve the right to determine your eligibility for any offer and to modify or withdraw offers at any time without notice.
7. Acceptable Use
You agree not to:
- Use the Services for any unlawful purpose or in violation of these Terms;
- Attempt to gain unauthorised access to our systems, other users' accounts, or data;
- Reverse engineer, decompile, or attempt to extract the source code of the Services, except as permitted by law;
- Upload or transmit any content that is unlawful, abusive, harassing, or infringes the rights of others;
- Use automated means (bots, scrapers) to access the Services without our prior written consent;
- Resell, sublicense, or commercially exploit the Services without our prior written consent.
We may suspend or terminate your account if we reasonably believe you have breached these Terms.
8. Your Content
You retain ownership of any content you submit to the Services, including meal photographs and messages ("User Content"). By submitting User Content, you grant Fitmate a non-exclusive, worldwide, royalty-free licence to use, store, and process that content solely to provide and improve the Services.
You are responsible for ensuring that your User Content does not infringe the rights of any third party.
9. Intellectual Property
The Services, including all software, text, graphics, logos, and other content (excluding User Content), are owned by or licensed to Fitmate and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Services except as expressly permitted by these Terms.
10. Third-Party Services
The Services may integrate with or link to third-party services, including WhatsApp, payment processors, and analytics providers. We are not responsible for the content, availability, or practices of third-party services, and your use of them is subject to their own terms and privacy policies.
11. Text Messages & Notifications
If you provide us with your mobile number, you may receive text messages, WhatsApp messages, or push notifications relating to your coaching programme. See our Privacy Policy for details on message frequency and how to opt out.
12. Disclaimers
The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of satisfactory quality, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or free of harmful components.
13. Limitation of Liability
Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be limited or excluded under English law.
Subject to the above, to the fullest extent permitted by law, Fitmate shall not be liable for any indirect, incidental, or consequential loss, or for any loss of profits, revenue, or data, arising out of or in connection with your use of the Services. Our total liability to you for any claim arising out of or in connection with these Terms shall not exceed the amount you paid to us for the Services in the twelve (12) months preceding the claim.
14. Indemnity
You agree to indemnify and hold Fitmate harmless from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your breach of these Terms or your misuse of the Services.
15. Termination
You may stop using the Services and delete your account at any time via the app or by contacting us. We may suspend or terminate your access to the Services if you breach these Terms, or for any other reason on reasonable notice. Provisions of these Terms that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) will survive.
16. Changes to These Terms
We may update these Terms from time to time to reflect changes to the Services or for legal or regulatory reasons. If we make material changes, we will notify you by posting the updated Terms on our website and updating the effective date above. Your continued use of the Services after any change constitutes acceptance of the updated Terms.
17. Governing Law & Jurisdiction
These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction to settle any dispute arising out of or in connection with these Terms, save that if you are a consumer resident elsewhere, mandatory local consumer protection laws may also apply.
18. Severability & Entire Agreement
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Fitmate regarding your use of the Services.
